This English text is a courtesy translation. In the event of any discrepancy, the French version prevails.
These terms of use (the "Terms") govern access to and use of the 1er.website site (the "Site"), as well as the tools made available free of charge, such as the email signature generator. They supplement the legal notice and the privacy policy.
1. Purpose
The Terms define the conditions under which any visitor (the "User") may browse the Site and use its features. They do not govern the paid services sold by the publisher, which are covered by separate terms of sale.
2. Acceptance
By accessing the Site, the User acknowledges having read these Terms and accepts them without reservation. If the User disagrees, they must not use the Site.
3. Access to the Site
The Site is freely accessible to any User with internet access. Connection and equipment costs remain the User's responsibility. The publisher endeavours to keep the Site available but cannot be held liable for interruptions, in particular for maintenance, updates or events of force majeure.
4. Free tools (email signature generator)
The Site offers free tools, including an email signature generator. Their use is subject to the following rules:
- Local data processing. The data entered (team members, contact details, imported images) is processed in the User's browser. On the free plan, none of this data is stored on the publisher's servers.
- Images. Images imported locally are resized and shown in a preview; exporting a signature with an image requires a URL hosted by the User.
- No warranty. The tools are provided "as is", with no guarantee of results or of compatibility with every email client. The User remains responsible for the content they generate and its use.
- Fair use. Any attempt to misuse, overload or compromise the security of the tools is prohibited.
5. Intellectual property
The Site's content (text, visuals, logo, code, structure) is protected and remains the property of the publisher, under the conditions set out in the legal notice. Signatures generated by the User from their own data belong to the User.
6. Personal data
The processing of personal data is described in the privacy policy, which the User is invited to consult.
7. Hyperlinks
The Site may link to third-party sites. The publisher has no control over these sites and accepts no responsibility for their content.
8. Liability
The publisher makes every effort to provide reliable information and tools, without being able to guarantee their completeness or the absence of errors. The publisher cannot be held liable for indirect damage resulting from use of the Site or its tools.
9. Changes to the Terms
The publisher may amend these Terms at any time. The applicable version is the one online at the time the Site is accessed.
10. Governing law
These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent courts of Lyon shall have jurisdiction.
